Official Rules

 

NO PURCHASE IS NECESSARY TO ENTER OR WIN. A TRANSACTION WILL NOT INCREASE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.

 

Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules.

  1. The RentPayment Sweepstakes (the "Promotion") will begin at 12:00am Eastern Standard Time (EST) on August 1, 2010 and end at 11:59pm Pacific Standard Time (PST) on December 31, 2010 ("Promotional Period"). The Sweepstakes is sponsored by RentPayment, 505 Sansome St., San Francisco, CA 94111 (the "Sponsor") who is solely responsible for all aspects of this Sweepstakes.
  2. Eligibility: The Sweepstakes is open to all legal residents of the 50 United States and the District of Columbia, 18 years of age or older by August 1, 2010. Employees, officers, directors and representatives of RentPayment, its parent company, affiliates, subsidiaries, licensees, service providers, advertising and promotion agencies, those involved in the production, development, implementation or handling of the Sweepstakes, the Sweepstakes Administrator (see below), any agents acting on behalf of the above entities, as well as the immediate family members (parents, children, siblings, spouses) and/or persons living in the same household (whether related or not) of each are not eligible to participate in the Sweepstakes. All federal, state and local laws and regulations apply. The Sweepstakes is void in Florida, New York, Rhode Island, Puerto Rico and where prohibited. Void where prohibited, taxed or otherwise restricted by law.
  3. All entrants must be eligible renters, rental property payers and leasers of residential communities from eligible residential communities that are managed by Management Companies that process electronic rent payments through RentPayment.com and RentPayment, Inc®.

  4. Automatic Entry: Eligible participants can enter the Promotion by paying their rent via any of the following channels:

     

    1. Over the Phone at 1-866-289-5977, with a RentPayment® Customer Service Representative OR via IVR the automatic phone processing.
    2. Online at RentPayment.com
    3. AutoPay payments. Automatically recurring direct debits from your checking or savings account, set up at RentPayment.com
    4. RentByText, set up at RentPayment.com

     

    Each rent payment made constitutes one entry in to the sweepstakes. All entries must be received by 11:59pm PST on December 31, 2010. LIMIT one entry per person per email address per month. Sponsor reserves the right to disqualify any person or email address that submits more than one entry. Incomplete entries, or those containing incorrect information, will be voided. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. Use of any automated system to submit entries is prohibited and will result in disqualification of all such entries as well as the entrant. By participating in this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the Sponsor which is final and binding in all matters relating to the Sweepstakes. All entries become the property of the Sponsor and none will be acknowledged or returned.

  5. To Enter without Purchase: On a 3.5" x 5" card write your name, complete address including your city, state, zip code, daytime phone number including area code, and the name of the property management company where you reside-this property must accept electronic payments with the RentPayment® Payment Platform. Please mail entries to: RentPayment, RentPayment Sweepstakes, 505 Sansome, 8th Floor, San Francisco, CA 94111.

     

    1. All mail-in entries must be post-marked no later than December 31, 2010 and received by January 10, 2011 to be included in the RentPayment Sweepstakes prize drawing. Each entry must be hand-printed and mailed separately; no facsimiles or mechanically reproduced entries accepted. All mail-in entries must contain sufficient postage and are limited to one (1) entry per person. Proof of sending will not be deemed to be proof of receipt by Sponsor; responsibility for receipt of entry rests solely with the entrant.
  6. Internet Limitations of Liability: If for any reason, this Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Sweepstakes, the Sponsor reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process (if applicable), and to cancel, terminate, modify or suspend the Sweepstakes in whole or in part, at any time, without notice and award the prize using all non-suspect eligible entries received as of the termination/suspension date. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor also is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure or delay of any email or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any website, or any combination thereof. Sponsor is not responsible for any damage to an entrant's system which is occasioned by participating in this Sweepstakes or by downloading any information necessary to participate in the Sweepstakes. Sponsor also is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the processing of the entries in the Sweepstakes. Any dispute or claim arising out of the play of this Sweepstakes, or any disputes with site users which arise as a result of the use of this website, shall be governed by the laws of the State of California, without respect to conflicts of laws principles. Any such claim shall be brought and maintained in the federal or state courts of the State of California. If any provisions of the Official Rules are determined by a court of competent jurisdiction to be invalid or unenforceable, such determination shall not affect the validity or enforceability of any other provision. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
  7. Prizes: One (1) Grand Prize winner will receive a $10,000 USD cash award. In addition, there will be 10 monthly prizes of $100 USDMasterCard Gift cards awarded throughout the Promotion Period. All monthly prize winners will be selected at random during the Promotional Period. After completing a rent payment, each entrant will be automatically entered into the Sweepstakes. Monthly prize winners are also eligible for the Grand Prize drawing.
  8. All prize winners that accept a prize of greater than $600 USD must note that the value of the accepted prize is taxable as income and the winners are solely responsible for all matters relating to the prize after it is awarded. By accepting the Grand Prize, the prize winner agrees to release the Sponsor and the Released Parties from any and all liability whatsoever for any injuries, losses, or damages of any kind caused by entering the promotion or for damages of any kind caused by any prize or resulting from acceptance, possession, or use/misuse of prize awarded. No substitution or transfer of prize will be permitted. The Sponsor reserves the right at its sole discretion to substitute the prize with another prize of equal or greater value in the event that any aforementioned prize is not available. All decisions by Sponsor as to prize winners and prizes are final. Chances of winning depend on the number of eligible entries received during the Sweepstakes Period.
  9. Prize Conditions: All prize winners are solely responsible for all applicable federal, state and local taxes and/or any other fees/costs associated with the prize or receipt of the prize. The one (1) Grand Prize winner and fifty (50) $100 USD MasterCard Giftcard Monthly winners will each be required to sign and return an Affidavit of Eligibility and Liability / Publicity Release (unless prohibited) within 14 days of written notification or prize winner will be disqualified. In the event of noncompliance with the Official Rules, if a winner cannot be reached at the address/phone number on winner's entry within 5 days of the first attempt, or if the prize or prize notification is returned as unclaimed or undeliverable, an alternate winner will be selected. The Grand Prize winner will be selected at the conclusion of the Promotional Period. Monthly winners will be selected on the 20th day of each month (or the first business day following the 20th). Prizes will be only awarded to verified winners. The winner's entry and acceptance of the prize constitutes permission (except where prohibited) for the Sponsor to use said winner's name, photograph, likeness, statements, biographical information, voice and address (city and state), in all forms of media, in perpetuity, without notice or further compensation.
  10. Sweepstakes Drawing and Notification: The Sweepstakes Grand Prize winner will be selected from among all eligible entries received by either entry method, in a random drawing conducted on or about January 10, 2011 by RentPayment (“the Administrator”). Odds of winning will depend on the total number of eligible entries received by either entry method. Potential winner will be notified by phone and/or mail. Upon initial notification and verification of potential winner, confirmation will be sent to winner in writing via USPS mail, or other home delivery service of Sponsor's choice.

  11. Notification of Winner (s) and Claiming of Prizes:

     

    Winner will be notified by telephone call or email message by Promotion Contact Points. Contact the RentPayment Marketing Department at 415.829.6922 or [email protected] for redemption of prizes.

     

    1. All winner(s) must complete and return a United States IRS W-9 form before prizes are distributed. The W-9 form will be distributed by YapStone® and must be returned to a Promotion Contact Point before the Redemption deadline.
    2. All winner(s) must complete and return a customer survey, provide a customer feedback testimonial and a photograph of the winner with a RentPayment promotion certificate by the Redemption Deadline. Any incomplete surveys or testimonials (less than 300 characters) will not be accepted.
    3. The RentPayment promotion certificate will be supplied by the RentPayment Marketing Department to the confirmed shipping address of the winner.

  12. Terms & Conditions: By entering the Sweepstakes, entrants agree to release Sponsor and its parent company, subsidiaries, affiliates, retailers, distributors and advertising and promotion agencies, and its and each of their respective directors, officers, employees, shareholders and agents from any and all liability, loss, damage or injuries of any kind sustained in connection with their participation in the Sweepstakes or from their acceptance, receipt, possession and/or use or misuse of the prize, or for any typographical or other error in the printing, offering or announcement of the prize. Entrants further acknowledge that said parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee express or implied, in fact or in law, relative to the prize, including, but not limited to, its quality or fitness for a particular purpose. Any person attempting to defraud or in any way tamper with the Sweepstakes mechanics and/or implementation will be prosecuted to the fullest extent of the law. By participating, entrants agree to waive any right to claim ambiguity in the Sweepstakes or these Official Rules. Sponsor reserves the right to disqualify any entrant that Sponsor determines, in its sole discretion, violates these Official Rules.
